Confidentiality

The University of Westminster takes its data protection obligations very seriously. Access to any personal information you give us in relation to any legal industrial action days is only handled by colleagues who are subject to confidentiality obligations. Access to your personal information is limited to only those colleagues who need access to support the management and correct administration of your contracted pay, to make reasonable communications to you and relevant University departments (“IAD Colleagues”) to enable the University to meet its public authority obligations.

This supplemental privacy notice (the “IAD Notice”) explains what we do with your personal information when it is collected in relation to legal industrial action, how we protect it and your rights.

This IAD Notice is supplemental to and should be read in conjunction with our Employee Data Privacy Statement.

Personal data

All affected University colleagues are required to declare whether they participated in any legal industrial action days. Your responses will be collected via an online declaration form and will include the following information about you:

  • Your name, University email address and your colleague identification number
  • Your declaration for any industrial action day(s)

Use of personal data

Your personal data and declaration will be held securely and processed by the IAD Colleagues for the purposes of:

  • The correct calculation of your pay and benefits, that may be subject to change related to your industrial action day(s) declaration; and
  • delivering any necessary industrial action day(s) related communications in line with our role as a University and public authority

If you took industrial action days, you are required to disclose this after the days in question, upon the reasonable request of the University.

Legal basis for processing and retention

We need your data in relation to your participation in industrial action day(s) to ensure your pay accurately reflects your actions and contracted terms and conditions. Therefore, as our lawful basis for the collection and processing of personal data, we are relying on the performance of a contract with you.

We will use colleague industrial action day(s) declarations to formulate necessary University communications because the University considers that this is a task that is necessary in the public interest.

Personal data relating to industrial action day(s) declarations will be retained in line with our Employee Data Privacy Statement.

Special category personal data

No special category data will be collected in relation in respect of the industrial action day(s) declaration.

Profiling and automated decision making

There is no automated decision-making processes – that is, decisions made by computer without human intervention – related to the collection of colleague industrial action day(s) declarations.

Data transfers and sharing

Your personal information related to your industrial action day(s) declaration is shared by the University with your pension provider for the purposes of the calculation of your pensionable working days. The University will not share this data with any other third party organisation, unless required by law or otherwise in accordance with the applicable data protection laws.
