This panel explores the legal issues pertaining to the assessment of the interests of justice before the International Criminal Court in light of the current investigation into the situation of Afghanistan. In particular, the panel analyses the interplay between the Office of the Prosecutor and the Chambers of the Court in relation to a decision not to open an investigation because this would not serve the interests of justice, taking into particular account the decision of the Appeals Chamber in March 2020.
